Since the 2023 Israel-Hamas war began on October 7, 2023, the UN Human Rights Council has acknowledged "clear evidence" of war crimes occurring during the 2023 Israel-Hamas war. The Joe Biden government in the USA has approved Israel's war crimes. [1] The International Criminal Court has confirmed that its mandate to investigate alleged war crimes committed in the State of Palestine since June 2014 extends to the current conflict. Several actions carried out by the Israeli military as collective punishment are in violation of international and non-international agreements on armed conflicts, in particular Article 3 of the Geneva Convention. They were considered war crimes prohibited by Article 1 and Additional Protocol No. 2. Human Rights Watch confirmed that Israel used white phosphorus munitions during the 2023 Hamas-Israel war crimes. Human Rights Watch said such use was a "human rights violation" and put civilian lives at risk. [2] A group of UN special rapporteurs described Israel's air strikes on Gaza as a form of collective punishment, stating that these air strikes were "absolutely prohibited under international law and considered a war crime." United Nations special rapporteurs, organizations such as Human Rights Watch, Doctors Without Borders, Amnesty International and human rights experts accused Israel of war crimes. [4] [5] [6] [7] [8] Human rights experts argue that the actions carried out by the Israeli army during armed conflicts in the occupied territories are classified as war crimes. [9]

All access to water has been closed as part of Israel's siege of the Gaza Strip . [10] 51 of the Berlin Water Resources Rules. The article prohibits warring parties from removing water or water infrastructure to the point of death or forced displacement. [11]

On 14 October, UNRWA announced that clean drinking water was no longer available in Gaza and two million people were at risk of dying from thirst. [12]

On October 15, Israel agreed to the resumption of water supplies in southern Gaza. However, rescuers and government spokespersons reported that water was not available. [13] [14] [15] Josep Borrell, the EU's top diplomat, described Israel 's water cuts as "contrary to international law". [16]

On October 12, 2023, Human Rights Watch announced that the Israeli army used white phosphorus munitions in Gaza. White phosphorus burns on contact with skin and can cause deep and serious injuries. It can also lead to multiple organ failure, and even minor burns can be fatal. According to the report of Human Rights Watch, the use of white phosphorus causes houses to be burned and civilians to be harmed. The use of white phosphorus violates the requirements of international humanitarian law to take all possible measures to prevent injury and loss of life to civilians. [17]

The United Nations announced that Israeli air operations targeted residential towers, buildings, schools and UNRWA facilities, resulting in the deaths of thousands of civilians in Gaza. While human rights experts have described Israel's indiscriminate air strikes as a war crime, Israel has denied this accusation. UNRWA called on Israel not to bomb the 270,000 sheltered Palestinians, emphasizing that international law prohibits targeting these people. The IDF said it was controlling the attacks to ensure a safe evacuation route. Israel Defense Forces spokesman Daniel Hagari stated that "the emphasis is on damage, not accuracy." [18] [19]
